The course will focus on the main legal issues related to the Internet and social media from a state and supra-state perspective, with particular reference to the following problematic profiles:
Technological evolution and challenges to law. Territorial sovereignty and digital technologies: overview of the main issues. The relations between States and private subjects of data intermediation. The Italian Constitution and the Internet. Articles 15 and 21 Cost. The potential of articles 2 and 3 of the Constitution, with particular reference to the digital divide. The "net neutrality" and its implications. Internet, social networks, information and political decision-making in the perspective of public law. Prospects and limits of the use of artificial intelligence in political decision-making. Social networks, fake news. Internet and personal data protection, the GDPR. Cybersecurity. The right to be forgotten. AI and Automated Decision-Making in the Civil/Administrative Justice System. Geolocation, forms of tracking and contact tracing.

Examination of the main constitutional and public law issues relating to the internet and social media, with particular reference to national and European Union legislation and state and EU jurisprudence with regard to: role of internet operators, right to be forgotten, art . 15 and 21 of the Constitution and right of communication in the Nice-Strasbourg Charter and ECHR, constitutional rights, protection of privacy, cyber security; role of social platforms and content control, transparency and privacy in the discipline of "transparent administration".
