Orientamento in ingresso

(objectives)
The course is in the meantime a deepening of chapters or paragraphs of the manual of private law and has the function of showing students that the notions of private law that they have learned serve to solve complex and controversial problems of interpretation of provisions regulations, and to identify the rules governing cases not directly regulated by the legislator, by analogy. Students will therefore discover the role of doctrine and jurisprudence. This is the purpose of training from a technical point of view.
The subject of atypical contracts is also one of the most ideological of private law, both because atypical contracts express the newer needs of big business, and because they are not regulated, the judge and the lawyer must assess the legality and meritoriousness of clauses that are all prepared and imposed by the economically strongest party, even if they are often contracts concluded between undertakings. Students will therefore also find out in what forms and to what extent ideologies affect doctrinal and jurisprudential orientations. This is the educational aim from a cultural point of view.
Finally, the course aims to make students know in depth the discipline of some very important atypical contracts and the problems of validity and merit that these contracts pose and therefore provide useful notions for the world of work. And that’s the practical end.
