EUROPEAN UNION LAW - A.A. 2019-2020 Dr. Emanuela Gentili Program: Institutional profiles. The evolution ordering EU from founding treaties to the Treaty of Lisbon. Institutional structure. In particular, the European Council, Council, Commission, European Parliament, European Central Bank, Court of Auditors. Structure and skills. Court of Justice and court system (in particular, the judicial protection of rights under EU and national). Sources: primary law and secondary legislation. Acts typical and atypical. Legislative and non-legislative. EU law and national law (transposition of EU law into Italian). Decision making. The system of EU competences. Relations between EU law and the law of the Member States. Adaptation of Italian law to the EU legislation. Union citizenship and the free movement of persons, the right of establishment and freedom to provide services. The free movement of capital. The free movement of goods. The Union's internal policies. Economic and monetary policy in particular. The discipline of competition. State aid to enterprises. Social policy, employment and vocational training. Health and Consumer Protection. Environmental Policy EU external action. The Common Foreign and Security Policy; the common security and defense policy. International agreements and relations with international organizations darkened. Didactic methodology: Frontal lesson with discussion in the classroom and specific insights. Lessons are held by the teacher through the slides support that are available on the portal. It should be noted that the recommended text and any notes taken for lessons (for the attendants) must be used for exam preparation. The course aims at examining all the most significant issues in European Union law, including in the light of recent developments. It will look at the institutional profile, fundamental rights, internal policies of the Union and external action. Some lessons will be devoted to specific insights: Brexit, the Union's environmental policy, analysis of some of the fundamental rights set out in the Charter of EU Rights and the problems of the Union related to the current migratory phenomenon.
